They\u2019re not reading your\u00a0\u201cdo not copy\/duplicate\u201d notes on your AO3 fic; their bots are pulling things directly from AO3, without AO3\u2032s authorization or assent. It looks like they are pulling from Wattpad too, again without authorization or assent.\u00a0<\/p>\n<p>While the Ebooks-Tree DMCA <a href=\"http:\/\/www.ebooks-tree.com\/info.php?dmca\" target=\"_blank\">page<\/a> seems to imply that you need a lawyer or other\u00a0\u201cauthorized person\u201d to submit a takedown notice, <i>you don\u2019t; you can do it yourself<\/i>.\u00a0<\/p>\n<p>As we\u2019ve posted before, fanfic writers hold copyright in their stories, although not in lines\/quotes from the works they\u2019ve been inspired by, and because of that, fanfic writers can submit DMCA takedown notices, or have someone do it on their behalf. While this post isn\u2019t legal advice (none of our posts on FYC are), you might want to consider using this template (well, the bolded bits) in <a href=\"http:\/\/www.ebooks-tree.com\/info.php?contacts\" target=\"_blank\">telling ebooks-tree to take down your content<\/a>:\u00a0<\/p>\n<blockquote class=\"xkit-colorquotes-border-item\">\n<div><b>Your Name and\/or Pseudonym as an e-signature\u00a0<\/b>(or the name of the person you\u2019ve authorized to submit this request, with a slash before it and after it):<br \/><b>Link(s) to the unauthorized works <\/b>(link to the pdf, the mobi and the page hosting all of it):\u00a0<br \/><b>Link(s) to an authorized version of your work <\/b>(whether on AO3, tumblr, LJ or somewhere else):\u00a0<br \/><b>An email address of the submitter<\/b>\u00a0(include it again even if it\u2019s in the header):\u00a0<br \/><b>This statement:<\/b> I have good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.<br \/><b>This statement:\u00a0<\/b>The information in the notification is accurate, and under penalty of perjury, that the complaining party is authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.<\/div>\n<\/blockquote>\n<p>That\u2019s it &#8211; that\u2019s all they need to know &#8211; you can submit all the info via <a href=\"http:\/\/www.ebooks-tree.com\/info.php?contacts\" target=\"_blank\">http:\/\/www.ebooks-tree.com\/info.php?contacts<\/a>\u00a0with\u00a0<b>DMCA Complaint<\/b> in the subject; you may wish to submit the same content to Google <a href=\"https:\/\/support.google.com\/legal\/answer\/3110420?rd=2\" target=\"_blank\">via this page<\/a>, or to BING <a href=\"https:\/\/www.microsoft.com\/info\/FormForSearch.aspx\" target=\"_blank\">via this page<\/a>.\u00a0<\/p>\n<p><b>ETA:<\/b>\u00a0If you try to read \u00a0your own fics, they require you to sign up via a site called\u00a0<a href=\"http:\/\/www.lazygame.net\/\" target=\"_blank\">http:\/\/www.lazygame.net\/<\/a>\u00a0(lazygamenet on Twitter, corporate name is KH Media LLC of Delaware, their phone number is <a href=\"https:\/\/www.google.com\/search?q=1-302+327+4042&amp;oq=1-302+327+4042&amp;aqs=chrome..69i57&amp;sourceid=chrome&amp;es_sm=119&amp;ie=UTF-8\" target=\"_blank\">listed<\/a>\u00a0as the contact number for\u00a0a bunch of different companies) and give your credit card info; we think that\u2019s probably a very bad idea. You can send the same DMCA info to them at\u00a0support@lazygame.net but it\u2019s unclear whether they have the ability to remove anything from the ebooks-tree site. We called LazyGame directly and they said they are not affiliated with ebooks-tree but they are affiliated with TzarMedia, which seems to be some sort of back-end for ebooks-tree. Fwiw, TzarMedia <a href=\"http:\/\/www.scamadviser.com\/is-tzarmedia.com-safe.html\" target=\"_blank\">isn\u2019t doing well<\/a> on the whole\u00a0\u201c<a href=\"http:\/\/www.scamadviser.com\/check-website\/tzarmedia.com\" target=\"_blank\">trustworthy site<\/a>\u201d thing.\u00a0<\/p>\n<p>TzarMedia claims that \u201cAll TzarMedia content is licensed and legal for distribution and use.\u201d We wonder what the FTC would say about that kind of false advertising.\u00a0<\/p>\n<p>This is way bigger than someone using a bot to pull fics; this is infringement in so many different ways.\u00a0<\/p>\n<p>(Fwiw, even though <a href=\"http:\/\/www.ebooks-tree.com\/info.php?dmca\" target=\"_blank\">ebooks-tree claims<\/a>\u00a0that they comply with the Copyright Act, they aren\u2019t compliant with the DMCA Safe Harbor rules, as they aren\u2019t listed on the <a href=\"http:\/\/www.copyright.gov\/onlinesp\/list\/u_agents.html\" target=\"_blank\">copyright.gov<\/a>\u00a0list of agents.)<\/p>\n<p>You can also submit a complaint about ebooks-tree to CloudFlare, who hosts the site. Their DMCA page is at\u00a0<a href=\"https:\/\/www.cloudflare.com\/abuse\/form\" target=\"_blank\">https:\/\/www.cloudflare.com\/abuse\/form<\/a>\u00a0&#8211; as a matter of law you do not need to include the legal name of the copyright claimant\/the fanfic writer, but \u00a0you should include the pseudonym that the fic was posted under if you don\u2019t want to include a legal name or address. \u00a0<\/p>\n<\/blockquote>\n<p>A lot of people have been writing into Support about this as well, and as much as we\u2019d like to prevent this kind of thing, there\u2019s only so much we can do while also keeping the downloads functionality alive for our users (who might depend on it due to limited internet time or mobile access only).<\/p>\n<p>We\u2019re already discouraging bots from accessing downloads in our robots.txt rules, which this kind of bot will happily ignore. We are also limiting how many files can be downloaded (and how fast) and we can tweak these settings further, although this isn\u2019t a bulletproof solution either. The only way we could prevent bots from downloading files would be to add a CAPTCHA button to downloads, and for a lot of accessibility reasons, we are not planning on doing this.<\/p>\n<p>To keep your fanfic locked away from anyone or anything that isn\u2019t a logged-in AO3 user, edit your work and tick the \u201cOnly show your work to registered users\u201d option, in the Privacy box.
